End User License Agreement

1. Grant of License

Limited License

Subject to your compliance with this EULA and all applicable laws, we grant you a non-exclusive, non-transferable, limited license to download, install, and use Butter Pass on compatible Android devices that you own or control for your personal, non-commercial use.

License Restrictions

You may not:

• Modify, adapt, translate, or create derivative works from Butter Pass
• Reverse engineer, decompile, disassemble, or attempt to discover the source code
• Copy, reproduce, or distribute Butter Pass to other devices
• Rent, lease, loan, or lend the App
• Remove or alter any proprietary notices, labels, or marks
• Use the App for commercial purposes or any illegal activities
• Access the App through automated means (bots, scraping, etc.)
• Transfer your license to another person or device

2. Intellectual Property Rights

Ownership

Butter Pass, including all content, features, functionality, design, graphics, and code, is owned by Butter Pass, its licensors, or other providers of content and is protected by copyright, trademark, and other intellectual property laws.

Your Rights to Your Data

You retain all rights to the card data you create or upload to Butter Pass. We do not claim ownership of your personal card information. However, by using the App, you grant us the right to use that data only to provide and improve the App's functionality.

Open Source

Butter Pass uses open-source libraries subject to their own licenses. You may review all third-party licenses within the App under Settings → Licenses.

3. User Conduct & Restrictions

You agree not to:

• Use Butter Pass to store, transmit, or facilitate illegal content or activities
• Harass, threaten, defame, or harm others
• Violate any applicable laws or regulations
• Use the App in any way that could damage, impair, or interfere with servers or networks
• Attempt to gain unauthorized access to the App or related systems
• Share your account or usage with others for commercial purposes

4. Disclaimer of Warranties

AS-IS Basis

Butter Pass is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We make no warranties that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

No Guarantees

We do not warrant that:

• The App will meet your specific needs or expectations
• The App is compatible with all devices or Android versions
• All functionality will be available at all times
• Any defects will be corrected

Data Loss

While we use industry-standard local storage practices, we are not responsible for any loss or corruption of card data due to device damage, software failure, or other causes beyond our reasonable control. You are solely responsible for backing up important card information.

5. Limitation of Liability

No Indirect Damages

To the maximum extent permitted by law, Butter Pass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.

Liability Cap

Our total liability under this EULA shall not exceed the amount you paid for the App (if any). Some jurisdictions do not allow liability limitations, so this may not apply to you.

Excluded Damages

We are not liable for:

• Loss or unauthorized access to your card data
• Barcode scanning errors or inaccuracies
• Your inability to access or use the App
• Financial losses or damages from using incorrect card information
• Failure to display your cards in-store due to device issues

6. No Liability for Third Parties

Butter Pass may link to third-party services like Google Play, camera functionality, or system theming. We are not responsible for:

• The accuracy or functionality of third-party services
• Any data transmitted to third parties
• Third-party terms of service or privacy policies
• Outages, errors, or issues with third-party services

7. User Support & Updates

No Guarantee of Support

While we aim to provide helpful support, we do not guarantee response times or resolution of issues. Support is provided "as is" without warranty.

Automatic Updates

Butter Pass may automatically update to fix bugs, add features, or improve security. You agree to accept updates as a condition of continued use.

App Discontinuation

We may discontinue or modify Butter Pass at any time. We will make reasonable efforts to notify users if we discontinue the App entirely.

8. Termination

Your Right to Terminate

You may terminate this EULA at any time by uninstalling Butter Pass from your device.

Our Right to Terminate

We may terminate or suspend your access to Butter Pass if you violate this EULA or engage in illegal activities. Upon termination, your right to use the App ceases immediately.

Effect of Termination

Upon termination, all data on your device remains your property. We have no obligation to retrieve or restore your card data after uninstallation.

9. Modifications to This Agreement

We may modify this EULA at any time. Changes will be effective upon posting the updated version to this website or notifying you through the App. Your continued use of Butter Pass after changes constitutes acceptance of the updated terms.

Material changes will be communicated prominently. Minor clarifications or formatting changes may be made without specific notification.

10. Indemnification

You agree to indemnify, defend, and hold harmless Butter Pass and its developers, licensors, and partners from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of this EULA
• Your use of the App in violation of applicable law
• Your card data or content you create or upload
• Your violation of others' rights

11. Governing Law & Jurisdiction

This EULA is governed by and construed in accordance with the laws of the jurisdiction in which Butter Pass is developed, without regard to its conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for any disputes arising from this EULA or your use of Butter Pass.

12. Severability

If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

This EULA, together with the Privacy Policy and any other legal notices published on the Butter Pass website, constitutes the entire agreement between you and Butter Pass regarding your use of the App and supersedes all prior or contemporaneous agreements, whether written or oral.

If there is any conflict between this EULA and the Privacy Policy, the Privacy Policy governs data collection and privacy matters, while this EULA governs usage terms and limitations of liability.
