Terms of Service

1. End User License Agreement (EULA)

Limited License: Subject to your compliance with these Terms, William Termini ("we," "us," or "our") grants you a non-exclusive, non-transferable, limited license to download, install, and use ButterPass on compatible devices that you own or control — Android smartphones and Wear OS smartwatches, and iPhone, iPad, and Apple Watch (as permitted by the App Store Usage Rules) — for your personal, non-commercial use.

License Restrictions: You may not modify, reverse engineer, decompile, or attempt to discover the source code of the App; rent, lease, loan, or sublicense the App; use the App for any illegal activities or commercial distribution; extract or misuse any signing material or credentials contained in the App; or remove or alter any proprietary notices or branding.

Updates: This license covers updates we provide unless an update is accompanied by separate terms.

2. Intellectual Property Rights

Ownership: All first-party code, design, and graphics for ButterPass are owned by William Termini and protected by intellectual property laws; third-party libraries remain under their own licenses.

Your Data: You retain ownership of the card data you enter or scan. Because ButterPass operates exclusively via local storage, we do not access, view, or host your data. We do not require a license to use your card data.

Open Source: ButterPass uses third-party libraries and system frameworks (for example ML Kit and UCrop on Android; Vision, PassKit, and Google Mobile Ads on iOS). Attributions and licenses are available within the App.

3. User Conduct & Restrictions

You agree not to use the App to store or facilitate fraudulent or illegal content; violate any local, state, or international laws; or attempt to gain unauthorized access to the App's restricted systems or bypass security measures. Cards, barcodes, and passes you create must relate to memberships and services you are genuinely entitled to use.

4. Disclaimer of Warranties

"As-Is" Basis: ButterPass is provided "AS IS" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or compatible with every device, Android version, or iOS version.

Data Loss: Your card data is stored locally on your device and mirrored to a paired Wear OS or Apple Watch device. We are not responsible for data loss resulting from device damage, software failure, OS updates, or uninstallation. Purchase status can be restored through the store you bought it from (Google Play or the App Store), but card data backups — including .bpass exports — are your sole responsibility.

5. Limitation of Liability

General Limitation: To the maximum extent permitted by law, William Termini shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid for the App (if any).

Specific Exclusions: We are not liable for (a) failure of a merchant's barcode scanner to read a card from your screen or watch; (b) a merchant's refusal to accept a digital version of a physical card or an exported wallet pass; (c) financial loss resulting from incorrect card details or balances entered by the user; or (d) issues arising from the Google Play or App Store billing process itself (including payment authorization, processing errors, or billing disputes).

6. In-App Purchases, Premium & Rewarded Ads

Premium: Premium is a one-time In-App Purchase that removes ads and lifts the watch sync limit. Everything else in ButterPass is free.

Rewarded Ads: On the free tier you may watch rewarded ads to unlock additional watch sync slots (and, where offered, other one-off feature uses). Unlock status is stored on your device and may be included in your device's system backups; it is not an account and we cannot restore it for you.

Billing Provider: All financial transactions and payment data are handled exclusively by Google Play Billing (Android) or Apple's App Store (iOS). We do not collect, see, or store credit card numbers or payment details.

Refunds: Refunds are governed by the policies of the store you purchased through and must be requested from Google Play or Apple respectively.

7. Third-Party Services

The App utilizes third-party tools and platform services (Google AdMob including its consent framework, Google Play Services on Android, and Apple services such as StoreKit and PassKit on iOS). We are not responsible for the availability, accuracy, or privacy practices of these third parties. Please refer to their respective terms. You agree to comply with applicable third-party terms (for example, your wireless data agreement) when using the App.

8. Apple App Store — Additional Terms

If you obtained ButterPass from the Apple App Store, the following additional terms apply:

• Acknowledgement: These Terms are an agreement between you and William Termini only, not with Apple Inc. ("Apple"). William Termini, not Apple, is solely responsible for the App and its content.
• Maintenance & Support: William Termini is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
• Warranty: In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Product Claims: William Termini, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or similar claims.
• Intellectual Property Claims: In the event of any third-party claim that the App infringes intellectual property rights, William Termini, not Apple, is responsible for the investigation, defense, settlement, and discharge of the claim.
• Legal Compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.

9. Updates & Discontinuation

Updates: We may provide updates to fix bugs or add features. Continued use of the App requires acceptance of these updates.

Discontinuation: We may modify or discontinue the App at any time. Since your data is local, you retain access to it on your device if the App remains installed.

10. Termination

You may terminate these Terms by uninstalling the App. We may terminate your license if you violate these Terms. Upon termination, you must cease all use of the App.

11. Indemnification

You agree to indemnify and hold harmless William Termini from any claims, losses, or legal fees arising from your misuse of the App or your violation of these Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms. Nothing in these Terms limits any non-waivable rights you have under the consumer protection laws of your place of residence.

13. Severability & Entire Agreement

If any part of these Terms is found to be unenforceable, the rest remains in effect. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding ButterPass.
